Pursuant to section 40 of The Legislative Assembly and Executive Council Act, 2007, Ms. Joan Beatty of the New Democratic Party vacated her seat in the constituency of Cumberland on January 3, 2008. On May 27, 2008, pursuant to an Order of the Lieutenant Govenor in Council, a Writ of Election was issued by the Chief Electoral Officer to Ms. Marlene Wolkosky, constituency returning officer. The Writ ordered that the by-election be held on June 25, 2008.
